1. Acceptance of terms
By creating a Kueup account, subscribing to a paid plan, or otherwise using the service, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree with any part of these terms, don't use Kueup.
2. The service
Kueup is a personalised streaming recommendation service. We use information you give us about your taste and the streaming services you subscribe to, combined with artificial intelligence (notably Anthropic's Claude), to suggest a small number of films and television shows for you to watch each day. Recommendations are delivered by email at a time you choose and are also visible on your dashboard at kueup.ai.
We don't stream video. Kueup recommends titles; the streaming services you subscribe to (Netflix, Max, Apple TV+, Disney+, and so on) are what actually play the content. You're responsible for maintaining your own subscriptions to those services.
3. Eligibility
To use Kueup, you must:
- Be at least 13 years old (and have the involvement of a parent or guardian if you're under 18).
- Have the legal capacity to enter into a binding agreement.
- Not be barred from using the service under the laws of your country or ours.
4. Your account
You're responsible for keeping your account credentials secure. You agree to:
- Provide accurate information during signup.
- Keep your password confidential and not share it with anyone.
- Notify us immediately at security@kueup.ai if you suspect unauthorised access.
- Take responsibility for all activity that happens under your account.
One person per account. Family plans support up to four profiles within a single household.
5. Subscriptions, billing, and cancellation
Plans
Kueup offers a free tier with limited features, and paid subscriptions (currently Pro and Family) with expanded pick counts, unlimited replacements, and additional features. Current pricing is displayed on the signup and billing pages. We may change pricing from time to time — any changes will be communicated in advance and will only affect your subscription at its next renewal.
Free trial
New users get a 7-day free trial of Pro features without needing to provide a payment method. After the trial, your account automatically reverts to the free tier unless you actively subscribe.
Billing
Paid subscriptions are processed by Stripe. By subscribing, you authorise Kueup and Stripe to charge your chosen payment method on a recurring basis (monthly or annually, as you select) at the then-current price. All prices are in US dollars unless otherwise stated. Taxes may apply based on your location.
Cancellation
You can cancel your subscription at any time from the billing portal on your dashboard. When you cancel, you keep access to paid features until the end of your current billing period. After that, your account reverts to the free tier — we don't delete your account or your pick history unless you ask us to.
Refunds
Subscriptions are non-refundable except where required by law. If you believe you've been billed in error, contact billing@kueup.ai within 14 days of the charge and we'll look into it.
Failed payments
If a payment fails, Stripe will attempt to retry the charge. If it continues to fail, your subscription will be downgraded to the free tier until payment is resolved.
6. Acceptable use
When using Kueup, you agree not to:
- Use the service for any illegal purpose or in violation of any applicable law.
- Attempt to reverse engineer, decompile, or otherwise extract source code from our apps or APIs.
- Scrape, crawl, or use automated tools to access the service beyond what our public API allows.
- Resell, sublicence, or otherwise commercially exploit the service or its output.
- Share your account credentials with anyone outside your household.
- Use the service to harass, threaten, or harm others.
- Interfere with or disrupt the service, our infrastructure, or other users.
- Upload or submit any content that infringes someone else's rights.
- Circumvent rate limits, plan gates (for example, the free-tier replacement limit), or other technical controls.
We may suspend or terminate accounts that violate these rules, with or without notice.
7. Content and intellectual property
Our content
The Kueup name, logo, interface design, and original editorial copy are owned by us and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable licence to use the service for its intended purpose.
Your content
You retain ownership of everything you give us — your preferences, feedback, and any other information you provide. By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to use that content solely to operate and improve the service. We will never sell your content to third parties.
Third-party content
Posters, synopses, cast lists, trailers, and similar metadata shown on pick cards and in emails are provided by The Movie Database (TMDB), Watchmode, and Trakt under their respective terms. This content is owned by its respective rights-holders and is shown to you for identification and discovery purposes only.
AI-generated recommendations
The one-line reasons accompanying each pick are generated by Anthropic's Claude based on your taste profile. While we try to produce recommendations that are thoughtful and accurate, AI output can sometimes be imperfect, outdated, or just plain wrong. Recommendations are suggestions, not guarantees — whether a pick is right for tonight is ultimately your call.
8. Third-party services
Kueup depends on a number of third-party services to function, including Anthropic, TMDB, Watchmode, Trakt, Stripe, Resend, Google (for Sign-In, if you use it), and DigitalOcean. When you use Kueup, you may also be subject to those providers' terms and privacy policies.
Kueup is not responsible for the availability, accuracy, or behaviour of third-party services, including the streaming platforms we recommend content on. If Netflix removes a title we suggested yesterday, that's between you and Netflix.
9. Disclaimers
Kueup is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties — including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We don't guarantee that Kueup will be uninterrupted, error-free, secure, or that recommendations will match your taste perfectly. We don't guarantee that content we recommend is currently available on the streaming services you subscribe to, or that the metadata shown is accurate at any given moment.
10. Limitation of liability
To the fullest extent permitted by law, Kueup and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.
Our total liability for any claims arising out of or relating to these terms or the service is limited to the greater of (a) the amount you paid to Kueup in the twelve months preceding the claim, or (b) one hundred US dollars ($100).
Some jurisdictions don't allow limitations like these. Where that's the case, these limitations apply only to the extent allowed.
11. Indemnity
You agree to indemnify and hold Kueup harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these terms, or your violation of any third-party rights.
12. Termination
You can stop using Kueup and delete your account at any time from your dashboard, or by emailing support@kueup.ai.
We can suspend or terminate your account if you violate these terms, if we're required to by law, or if we decide to discontinue the service. Where possible, we'll give you advance notice so you can export any information you want to keep.
Termination doesn't relieve you of any obligations (like outstanding payments) that accrued before termination. Sections that by their nature should survive (IP, disclaimers, liability, indemnity, governing law) survive termination.
13. Changes to the service and these terms
We're actively building Kueup and features will change over time. We may add, modify, or remove features at our discretion.
We may also update these terms. When we make material changes, we'll email active users at least 14 days before the changes take effect and update the "last updated" date above. Continuing to use Kueup after changes take effect means you accept the new terms. If you don't accept them, stop using the service and cancel any subscription before the effective date.
14. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or your use of Kueup will be resolved in the state or federal courts located in Contra Costa County, California, unless applicable law requires otherwise.
Before filing any formal legal action, you agree to contact us at legal@kueup.ai and make a good-faith effort to resolve the dispute informally.
15. Miscellaneous
- Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and Kueup regarding the service.
- Severability. If any part of these terms is held unenforceable, the rest remains in force.
- No waiver. Our failure to enforce any part of these terms isn't a waiver of our right to enforce it later.
- Assignment. You can't transfer your rights under these terms without our written consent. We can assign our rights and obligations freely (for example, in a sale of the company).
- Force majeure. We aren't liable for failures caused by events beyond our reasonable control (natural disasters, war, outages at third-party providers, and so on).
